Before you book a session, please take a few minutes to review these Terms & Conditions. By using our website or booking a photo session with us, you’re agreeing to the following terms — so let’s make sure we’re all on the same page.

1. Who We Are and What We Do
The Photo Fox connects you with talented photographers for relaxed and professional photo sessions at preset times and locations. We take the stress out of the process — no digging through endless portfolios, no awkward negotiations, no back and forths on dates and times, just beautiful photos delivered quickly and affordably — no pressure, no gimmicks.
All of our photographers are independent contractors, not employees of The Photo Fox. While we carefully vet and schedule each one, they run their own photography businesses and are fully responsible for the equipment they use, the photos they take, and the artistic direction they bring to your session.
2. Booking a Session
Booking a session is easy — just choose a date, time, and location that works for you from the options listed on our website. Session lengths can vary and will be clearly stated during the booking process.
Each session can accommodate up to 8 people. If your group is larger than that, we recommend booking multiple back-to-back sessions. If you arrive with more than 8 people and haven’t booked additional sessions, your photographer may ask you to reschedule.
You’ll pay a small retainer fee to hold your spot. The retainer is returned to you after the shoot as a digital credit toward image purchases. It's refundable if canceled 5+ days in advance. No images are included with the session itself.
The credit must be used before your gallery expires (typically two weeks). Any parking fees or entrance costs are your responsibility.
3. Canceling or Rescheduling Options
You may cancel or reschedule for free up to 5 days in advance. After that, we retain the retainer to compensate the photographer.
- 5+ days: full refund of retainer
- Less than 5 days: non-refundable
- No-show: forfeited retainer and possible future restriction
Sessions run back-to-back. If you're late, your session still ends at the scheduled time and fewer images may be delivered.
4. After Your Session
You'll receive an email within a week with a link to your gallery, containing at least 30 lightly edited photos. You can view and purchase images at your convenience.
Your gallery will be live for about two weeks. After that, the images will no longer be available.
5. Working with Our Photographers
Photographers bring their own gear and style. They determine session flow, photo selection, and edits.
Please don't take your own photos or video during the session. The photographer is the only one authorized to shoot.
Kindness and professionalism are expected. If inappropriate behavior occurs, the photographer may end the session with no refund. Let us know if anything feels off — we're here to help.
6. Refunds & Satisfaction Guarantee
Photo Sessions
We don’t refund session retainers, but we offer a one-time free redo for your first session — with a different photographer if you prefer.
- Available for your first session only
- Request within 20 days
- No downloads/screenshots/sharing before request
- Original gallery will be removed after a redo is requested
Photo Purchases
All digital and print sales are final and non-refundable due to the nature of delivery and custom production.
7. Photo Usage & Copyright
- Purchased images include personal use rights
- Commercial use requires separate licensing
- The Photo Fox retains copyright to all images
You also grant us and the photographer permission to use your image/name/likeness for promotional purposes. Just email us if you'd prefer your images not be used publicly — we're happy to accommodate.
8. Privacy & Your Data
- We collect only necessary data: name, email, phone, session info
- Used only for session management — never sold or shared with marketers
- Galleries are password-protected
- Images may be used for marketing unless you request otherwise
- We'll always ask before using your photos in ads or larger campaigns
9. Disputes & Limitation of Liability
Please contact us first if you're unhappy — we're reasonable people.
- We're not liable for indirect damages or emotional distress
- Maximum liability is what you paid for the session
- You assume responsibility for your own safety and belongings during the session
10. Tech Failures, Weather, and Other Unforeseen Events
If a technical issue prevents delivery of your images, we’ll issue a prorated refund based on the portion undelivered.
If we cancel due to weather or illness, we’ll work to reschedule or apply your retainer to a future session — refunds aren’t available in these cases.
11. Modifications and Termination
We may update these Terms from time to time. We’ll always refresh the "last updated" date and notify you if major changes affect your rights.
We may also cancel/refuse future service for repeated no-shows or violations. You’re free to stop using our services any time.
12. Mobile Messaging
Booking a session may result in SMS reminders. Standard message and data rates may apply.
13. Legal Stuff (Governing Law, Severability, Etc.)
- Governing Law: These Terms are governed by Utah law.
- Severability: If part of these Terms is unenforceable, the rest still applies.
- No Waiver: Delay in enforcement doesn’t waive our rights.
- Entire Agreement: These Terms represent the full agreement between you and The Photo Fox.
- Assignment: You can’t transfer your rights without our written permission.
- Mutual Respect: We aim to treat you kindly and professionally — and ask the same from you. Let us fix problems before they go public.
